Terms of service

GENERAL

1. The En Gold website and online store, located at www.engold.com.au (Website), is owned, controlled and operated by En Gold Studio Pty Ltd (ABN 22 644 228 526) t/as En Gold, of Shop 2, 946 High St, Armadale VIC 3143 (En Gold, We, Our, and/or Us). 
2. As a condition of using and/or purchasing from the Website, you agree to the following terms and conditions (Terms) and to be legally bound thereby. 
3. If you do not agree with the Terms, you should stop using the Website. 
4. En Gold has the right to vary the Terms at any time and without notice to you. You agree that it is your responsibility to be aware of any changes made to the Terms, and by continuing to use and/or purchase from the Website you agree to be governed by the Terms as varied from time to time. 

 

ORDERING, PRICING & SHIPPING

1. To purchase products via the Website, you must possess a valid credit or debit card issued by a bank acceptable to Us. We use Shopify, a third party payment processor, to process all credit card payments and do not collect or record any credit card details provided by you when making purchases via the Website. 
2. By placing an order via the Website (Order), you are offering to purchase the products on and subject to these Terms. You agree that We have the right to accept or reject an Order for any reason at any time, and all Orders are subject to availability of the products. 
3. An Order confirmation will be sent to you in acknowledgement of receipt of your Order. This document supersedes all prior correspondence in relation to your Order (verbal, written, graphic or otherwise). Any changes to the Order may only be made with Our approval. 
4. Product prices and shipping fees (if applicable) are specified on the Website. We reserve the right to change pricing at our discretion and without notice. Unless otherwise stated, all prices are in Australian Dollars and are inclusive of GST. 
5. Any period or date given by Us for the shipping of an order is intended as an estimate only and may be subject to change. We take no responsibility for any loss suffered by you where an Order is not delivered within the estimated time frames.

 

AUSTRALIAN CONSUMER LAW

1. Our goods and services come with Consumer Guarantees under the Australian Consumer Law, which cannot be excluded by these Terms.  Nothing in these Terms shall override your rights as a Consumer or otherwise at law.

 

RISK

1. Title in the products comprising an Order/s is retained by Us and will not pass to you until full payment in cleared funds are received by Us. 
2. In utilising our En Gold furniture and products, customers hereby acknowledge and accept the following limited liability terms: Our business shall not be held responsible or liable for any injuries, damages, or harm, including but not limited to physical injury, property damage, or financial loss, arising from the use, misuse, or inability to use our products. Customers agree to use our furniture and products responsibly and in accordance with its intended purpose. Our liability is limited to the purchase price of the furniture. This limitation of liability applies to all claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory. By purchasing and/or using our furniture, customers waive any claims against our business for such injuries or damages. Customers are advised to review and comply with all safety guidelines provided with our products. If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. 
3. It is your responsibility to inspect all products on delivery. Any damage must be noted on the delivery docket presented to you by the courier for signature. If you believe that your Order has been lost or damaged in transit, please contact hello@engold.com.au. Notification and images of any damage or missing goods is required to be sent to us by email within 24 hours of delivery. Subject to clause 10 and to the extent permitted by law, We will not be responsible for any damage unless we are notified within the time period specified. 
4. Please note that We do not provide refunds for ‘change of mind’. Subject to the clause 10, all sales via the Website are final and binding unless We agree otherwise. 

 

PRIVACY

1. We value you, our customers, and are committed to the transparent management of your personal information.
2. So that We can fulfil your Order/s, We will need to collect certain personal information from you.
3. We agree to take reasonable steps to protect your personal information submitted to us via the Website. 
4. As part of agreeing to the Terms, you also consent to us using your personal information for direct marketing purposes to provide information to you about the Website, and Our products and promotions. You are able to opt-out of direct marketing communications at any time.
5. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behaviour and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. INTELLECTUAL PROPERTY

1. ‘En Gold’ is a trade mark of En Gold Studio Pty Ltd. Other product and company names displayed on the Website may also be trade marks of their respective owners.
2. We are the exclusive owner of, or otherwise have a licence to use, all images, videos, literary works, designs, source code and data, and any other copyright matter contained in the Website (Content). You may download, view, copy and print any Content for personal, informational and non-commercial purposes only. All other uses are strictly prohibited. You must obtain Our prior written permission if you would like to use, copy, repost, store, sell, upload, distribute or reproduce any part of the Website or Content for any other purpose.

 

THIRD PARTY LINKS

1. The Website may include links to third party websites, over which We have no control. Such links do not indicate, expressly or impliedly, any endorsement by Us of the third party website or the products and services provided thereon. You agree that We are not responsible for the availability of, and content provided on, third party websites. We make no representations or warranties as to, and accept no responsibility for, the accuracy of information on third party sites, or that third party sites will be virus free. 

 

LIMITATION OF LIABLITY

1. Subject to clause 10, without overriding any Consumer Guarantees and to the extent permitted by law, En Gold:
1. does not make any representations, warranties or guarantees in relation to the supply of goods and services by En Gold via the Website; and
2. hereby disclaims all liability in connection with any loss and/or damage arising out of or in connection with any use of, or reliance on, the Website. 
   
3. En Gold will not be held responsible for damages or injury caused by misuse of goods. Any treatment of goods other than the intended purpose is considered misuse. 

 

INDEMNITY

1. You agree to indemnify and hold En Gold (and its offers, employees and other representatives) harmless from all loss and any claims (on a full indemnity basis) suffered by you due to or arising out of, or in any way, connected to you breaching the Terms. 

 

GOVERNING LAW

1. The Terms are governed by and are to be construed in accordance with the laws of the State of Victoria, Australia and you agree that the courts of the State of Victoria, Australia shall exclusively adjudicate over any dispute in relation to these Terms.
2. Our business reserves the right to update or modify these terms and conditions at any time without prior notice.

We do not tolerate any form of forced, bonded, or child labour. We take steps to prevent modern slavery risks by maintaining clear communication with our suppliers, requiring compliance with local labour laws and international standards, and fostering a culture of transparency and respect.

We continue to review and strengthen our processes, aiming to improve visibility throughout our supply chain and ensure we are living up to our values.
